ezCater, Inc. (“ezCater,” “we,” “us,” or “our”) provides these SMS Terms and Conditions (the "SMS Terms"), which govern the provision and delivery of text messages by us or our text message service providers to you (the “ezCater Text Messages”).
By agreeing to receive ezCater Text Messages, you consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by emailing ezCater at email@example.com with "Revoke Electronic Consent" in the subject line.
To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. For a free paper copy, or to update our records of your contact information, email ezCater at firstname.lastname@example.org with contact information and the address for delivery.
Consenting to Receipt of ezCater Text Messages
By consenting to receive ezCater Text Messages, you agree that ezCater or its service providers may use any automated or non-automated technology to send you ezCater Text Messages to the cell phone number associated with your consent. This may be the number you provided or used when you consented to receive ezCater Text Messages, or the number we have on file for your account. The ezCater Text Messages you receive may be informational or transactional, or they may include promotional or personalized marketing content.
Text messages operated through our 61210 short code are informational and transactional messages. For example, you may receive ezCater Text Messages from us or our service providers that: (1) provide you with information you requested from us; (2) update you regarding your orders and other transactions with us; and/or (3) respond to your customer service requests and other inquiries regarding your use of our services.
Text messages operated through our 34316 short code have marketing or promotional content. For example, you may receive ezCater Text Messages from us or our service providers that include discounts, coupons, or other offers.
Costs of ezCater Text Messages
ezCater does not charge you for our text message program. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
Frequency of Text Messages
We may send you an initial message confirming your enrollment in the ezCater Text Messages program. After that, you will receive recurring text messages, and the specific amount may vary depending on a number of factors including how you use our services (e.g. the number of orders placed or received) and whether you take steps to generate additional text messages from us (such as by sending a HELP request).
Content is not available on all carriers and carrier participation could change. As of November 24, 2021, our text messages can be sent through the following carriers:
AT&T, Verizon Wireless, Sprint, T-Mobile USA, Aio Wireless, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Boost Mobile, Carolina West Wireless, CellCom, Cellular One of East Central IL (ECIT), Cellular One of Northeast Arizona, Cellular One of Northeast Pennsylvania, Chariton Valley Cellular, Cricket, Coral Wireless (Mobi PCS), Cross, C-Spire (CellSouth), Duet IP (Maximum Communications New Core Wireless), Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Google Voice, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Metro PCS, Mosaic (Consolidated or CTC Telecom), MTA Communications, MTPCS (Cellular One Nation), Nex-Tech Wireless, Panhandle Communications, Peoples Wireless, Pine Cellular, Pioneer, RINA, Sagebrush Cellular (Nemont), SI Wireless/Mobile Nation, Simmetry (TMP Corporation), SouthernLinc, SRT Wireless, Thumb Cellular, Union Wireless, United Wireless, U.S. Cellular, Viaero Wireless, Virgin Mobile, and West Central (WCC or 5 Star Wireless).
The content is not compatible with all cell phone models. Please note, however, that the supporting mobile carriers may change without notice. ezCater and the mobile carriers (for example, T-Mobile) are not liable for delayed or undelivered messages.
Opting Out of ezCater Text Messages
For informational and transactional text messages operated through 61210, you can get help by texting HELP to 61210, and you can opt out by texting STOP to 61210. For marketing text messages operated through 34316, you can get help by texting HELP to 34316, and you can opt out by texting STOP to 34316. For text messages sent from a different phone number, text HELP to that number for help, and to opt out, you must text STOP to that number. After doing so, we may send you confirmation of your opt-out via text message. If you have revoked consent and want to re-enroll in our text message program, you can re-enroll by texting START to the applicable number or otherwise enrolling through our website or through communications with us.
Modifications to these SMS Terms
We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in ezCater’s text messaging program shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
