PLEASE NOTE THAT DISPUTES ABOUT THESE REWARDS LOYALTY PROGRAM TERMS AND CONDITIONS AND THE REWARDS LOYALTY PROGRAM (AS DEFINED BELOW) ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS, AS DETAILED IN
SECTION 18 OF THE EZCATER TERMS OF USE.
References to “these Terms” in Section 18 of our Terms of Use include these Loyalty Program Terms and Conditions.
These Rewards Loyalty Program Terms and Conditions (the "Rewards Program Terms") govern the Rewards loyalty program (the “Rewards Program”) operated by ezCater, Inc. (“ezCater,” “we,” “us,” or “our”). By engaging in any activity that earns you points in the Rewards Program (“Rewards Points”), you agree to be bound by these Rewards Program Terms. It is the responsibility to read and understand the terms and conditions regarding the Loyalty Program outlined below. These Rewards Program Terms, along with the ezCater Terms of Use and Privacy Policy, govern your participation in the Rewards Program. If you do not agree to these Terms and Conditions, the ezCater Terms of Use and Privacy Policy, you must not participate in the Rewards Program. The ezCater Terms of Use and Privacy Policy are subject to change from time to time.
Enrollment
When you create an ezCater account, you are automatically enrolled in the Rewards Program unless your account is associated with an ezCater Enterprise account maintained by your employer or organization. In such cases, your employer or organization may elect not to offer the Rewards Program to its employees or members, or may otherwise restrict how Rewards Points may be earned and used. Your ezCater Enterprise organization retains final authority over any Rewards Points accumulated in connection with orders placed on its behalf or through its ezCater Enterprise account.
Program Benefits
Eligible users will receive at least one point for each $1 of qualified spend you have through the ezCater marketplace. Qualified spend is the amount you pay for all food and beverage orders you place through the marketplace, minus any coupons, discounts and credits applied to your order, and before taxes, delivery fees, voluntary tip, or any other fees are applied. Some caterers may offer additional points for orders you place with them. You may also receive points for participating in specific opportunities we offer from time-to-time, such as reviewing caterers or referring friends to ezCater.
How to Use and Redeem Rewards Points
You must be an Active User to redeem points. You are an “Active User” if you have placed a fulfilled order in the last 12 months. If you are an Active User, you can redeem points in any quantity as a discount on a marketplace order. You can also redeem points for Amazon Gift Cards if you have at least 2,500 points (2,500 points can be redeemed for a $25 gift card).
You can redeem your points as a discount on a marketplace order when you place an order. You can redeem your points for Amazon Gift Cards by visiting the Rewards section of the website and selecting Redeem Now. Restrictions apply; ezCater is not the issuer of Amazon Gift Cards and is not responsible for any terms, conditions, availability, or restrictions associated with the use of such cards. All Amazon Gift Cards are subject to the terms and conditions set forth by Amazon, see amazon.com/gc-legal for complete Amazon Gift Card program details.If your account is associated with an ezCater Enterprise account, the redemption of Rewards Points may be subject to and governed by the policies and/or restrictions of your employer or organization.
Rewards Points Expiration
Your Rewards Points will expire if you have not placed a fulfilled order through the marketplace in the last 12 months. If you have not previously created an ezCater account and have earned Rewards as part of a limited-time offer for new users, those Rewards will expire if you do not create an eligible ezCater account and place a fulfilled order within 12 months.
Other Important Rewards Program Information You Should Know
Except as explicitly provided herein, Rewards Points are non-transferrable, may not be resold, and are not redeemable for cash or as a credit on past orders. You agree we may change these Rewards Program Terms, terminate the Rewards Program, or expire, deduct, limit, or modify your Rewards Points at any time for any reason, including in the event we determine or believe that your participation in the Rewards Program was in error, fraudulent, illegal, or otherwise in violation of these Rewards Program Terms. If you join an ezCater Enterprise account, any Rewards Points earned prior to joining may be transferred to and pooled with your employer’s or organization’s account. Where possible, ezCater will provide you with notice before any such transfer. Rewards Points earned in connection with or on behalf of an ezCater Enterprise account will remain with the employer or organization if you leave the ezCater Enterprise account.
Governing Law; Severability
These Program Terms shall be construed in accordance with and governed by the laws of the Commonwealth of Massachusetts consistent with the Federal Arbitration Act, without regard to its conflict of law principles. If a lawsuit or court proceeding is permitted under these Program Terms, you and we agree that the dispute must be initiated and conducted exclusively in the state or federal courts of Suffolk County, Massachusetts, and you and we consent to the exclusive jurisdiction of such courts. If any provision of these Program Terms is found to be invalid or unenforceable to any extent, then the invalid portion shall be deemed conformed to the minimum requirements of law to the extent possible. In addition, all other provisions of these Program Terms shall not be affected and shall continue to be valid and enforceable to the fullest extent permitted by law.

The Rewards Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of our control. We are not responsible for any unavailability, interruptions or errors of the Rewards Program, or any Rewards. We may modify, suspend, or discontinue the Rewards Program or any feature at any time without notice. The Rewards Program and all the information accessible through it are provided for information purposes only on an “as is” and “as available” basis. We make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Rewards Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
